Legal Defence

  • Derek is a board member of his condo corporation and was presenting significant changes to the condo’s bylaws, when he got into a very heated exchange with an owner attending. The arguments and name calling even carried on after the meeting was adjourned, and there was some pushing and shoving as well. The next day, police knocked on his door and advised he was being charged for an alleged assault that the owner claimed took place later that night in the parking garage.

A Civil Resolution Tribunal Notice was filed by the original washing company, demanding full payment as per the original 2017 contract, which was not officially terminated by the new strata council.
  • Emily, a council member, was given the task to handle this issue and she called the Legal Helpline to get some initial information to take back to her colleagues. ARAG also assigned a lawyer who undertook negotiating a settlement between the council and window washing company.

Bodily Injury

  • Joanna was on her way to an offsite condo corporation meeting, when she fell down a flight of stairs with a faulty hand railing. Joanna suffered multiple fractures and an extended recovery which kept her away from her work and condo corporation duties.

Strata Council and Owner Disputes (Available in British Columbia and Alberta only)

  • An owner and irate ex-council member initiated a Civil Resolution Tribunal dispute against the strata, alleging multiple breaches of bylaws by the council, along with an extensive list of other accusations. The request was that the council be disbanded and election be considered void, and various council members be personally responsible for expenses.
  • Manraj and his fellow council members were at their wits end with this individual and called the Legal Helpline. A lawyer was assigned who collected all the facts and submitted a detailed counter submission to the tribunal, which resulted in the owner doing a resubmission with more details.
